As used in this Privacy Policy, “Personal information” is information that identifies, relates to, describes, or is capable of being associated with, a particular individual. This Privacy Policy is intended to inform you of our policies and practices regarding the collection, use and disclosure of any Personal Information that we collect from users of our Site. Our Privacy Policy does not apply to any websites or other online services not listed above. For example, our Privacy Policy does not apply to services offered by other companies or individuals, including products or sites that may be displayed to you in search results, sites that may include Company services, or other sites linked from our Site. Our Privacy Policy does not cover the information practices of other companies and organizations who advertise our services and who may use cookies, pixel tags and other technologies to serve and offer relevant ads.

We recognize your concern over how information we may obtain about you is used and shared.  This Privacy Policy describes how we intend to use such information. By visiting the Site, you are accepting the practices described in this Privacy Policy and the Terms of Use.

  1. Client Information

The information we collect from individuals (“clients” or “you”) helps us personalize and continually improve our services to you.  Here is a non-exclusive list of the types of information we gather about our clients:

  • Information You Give Us

We receive and store any Personal Information you provide to us including, for example, information you enter on our Site, such as names, e-mail addresses and other personal information, information that you send us by mail or email and any information you provide by phone or in person. You can choose not to disclose certain information, but then you might be limited in the services you can take advantage of.  We use the information that you provide for such purposes as:

  • If you tell us where you are (e.g., by entering your city or zip code information), we may use that information to provide you with location-based information, such as the location of managed properties near you.
  • If you provide us feedback or contact us via email, we will collect your name, email address, phone number, mailing address, as well as any other relevant information, in order to send you a reply and for other purposes such as improving the quality of our products and services.
  • We use information that clients provide in order to process lease requests and otherwise provide our services and protect our rights.
  • If you create an account, we will collect all information you provide that relates to our properties and your rental unit, lease or other information.
  • We also collect other types of Personal Information that you provide to us voluntarily, such as any information requested by us if you contact us by phone or via email regarding support.
  • Automatic Information

We receive and store certain types of information whenever you interact with us or visit the Site.

  • Information Collected by our Servers. When you enter the Site, to make the Services more useful to you, our servers (which may be hosted by a third-party service provider) collect information from you, including, for example, web pages visited as well as the page visited prior to, or upon leaving, a site, your browser type, domain name, date/time stamp for your visit and your and Internet Protocol (IP) address (a number that is automatically assigned to your computer or device when you use the Internet). We use this information to analyze trends, administer our services, monitor for fraudulent activities and for the efficacy of our fraud management tools, and better tailor our services to our users’ needs. This information is gathered for all Site visitors.
  • Cookies. We may also obtain lists of individuals or contact information in order to provide them with information about our services. In the case of some services, we may receive this information based on a consent from you. In other cases, we may receive information because you apply for housing or participate in a program that utilizes or offers services to you.

  • General Use.

We may block delivery of a communication or remove content if it violates our Terms of Use.   • Targeted Marketing.

We and our Analytics Companies may implement and evaluate our marketing activities, including to engage in targeted and personalized online advertising, in third-party website, application, television, or other online or offline services operated by third parties. This marketing may be targeted to you based on personal or other information collected over time, such as through your use of our services, the Site, your browser’s geographic location (which may include longitude and latitude), your activity on unaffiliated third-party websites, applications, or other online services, other marketing activities and programs, and/or from third parties with whom we work. We and our Analytics Companies may use tracking technologies to collect information for such marketing and evaluation purposes. We and our Analytics Companies also may identify whether our marketing activities resulted in you engaging in other activities on our Site, our advertising and/or marketing, obtaining services from us or our affiliates, or otherwise engaging with us. In addition, we and our Analytics Companies may target ads to you if we or our Analytics Companies have identified you as a client using information we share with them, such as your name, email address, or mailing address.

  • Cross-Device Technologies.

We and our Analytics Companies may use collected information to establish connections among related web browsers and devices (such as smartphones, tablets, computers, and televisions) for targeted advertising, analytics, attribution, and reporting purposes. We and/or our Analytics Companies may match your browsers or devices if you log into the same online service on multiple devices or if your devices share similar attributes that support an inference that they are used by the same person or household. This means that your online behavior (i.e., information about your activity on websites or applications on your current browser or device and your device’s geographic location, which may include specific longitude and latitude) may be combined with information collected from your other browsers or devices. For example, our Analytics Companies may use this information to deliver an ad on your tablet or smartphone, to limit the number of times you see an ad across your devices, and to help measure the effectiveness of advertising campaigns across devices.

  • Creation of Anonymous Data.

We may create anonymous records and data from Personal Information by removing information (such as your name) that make the information personally identifiable to you. We may use this anonymous information to analyze request patterns and usage patterns so that we may enhance our Site and services and for other purposes. In addition to any other uses and disclosures permitted under this Privacy Policy, we reserve the right to use and disclose anonymous information to third parties in our discretion for any legal purpose.

  1. Sharing Client Information

Information about our clients and website visitors (collectively referred to as “clients”) is an important part of our business, and we do not sell personally identifiable client information to others, though we may use and share client information as described below:

  • Third Parties

We employ or may employ in the future other companies and individuals to perform certain services on our behalf.  In providing information and services to our clients, it may be necessary or expedient for us to give third party vendors (such as property managers, repair and grounds vendors, and Analytics Companies as described above) information about clients, including financial information.  We do not provide client information to any third parties unless it is helpful or necessary to the services we provide for our clients or as otherwise described in this Privacy Policy.  Further, these service providers have access only to the client information reasonably necessary for the performance of their functions. Examples of such third-party services may include when we engage contractors who work with client data or when we use web-based applications for client work to: (i) provide you with the services that we offer you; (ii) to conduct quality or other reviews; (iii) to facilitate the creation of accounts; (iv) to process payments; (v) to provide technical support; (vi) to process applications, check credit, perform background checks, etc.; and/or (vii) to provide other services to you or us.

We may share some or all of your Personal Information with our parent company, subsidiaries, joint ventures, or other companies under common control, in which case we will require our affiliates to honor this Privacy Policy regarding the Personal Information we provide.

  • Corporate Restructuring.

We may share some or all of your Personal Information in connection with or during negotiation of any merger, financing, acquisition, sale of ownership interests or assets, or dissolution transaction involving the sale, transfer, divestiture, or disclosure of all or a portion of our business or assets. In the event of a sale or an insolvency, bankruptcy, or receivership, Personal Information also may be transferred as a business asset. If our company, business or assets is acquired by another company, that company will possess the Personal Information collected by us and it will assume the rights and obligations regarding your Personal Information as described in this Privacy Policy.

  • Legal Requirements and Protection

We release Personal Information when we believe release is appropriate to comply with law; enforce or apply agreements; or protect the rights, property, or safety of the Company, our clients, or others, including exchanging information with other companies and organizations for fraud protection and credit risk reduction.

  • Information you share.

Our Sites may let you share information with others. There also may be areas within our properties where information may be posted. Remember that when you share information publicly, it will be generally viewable by the public and any information posted on a Site may be indexable by search engines.

  • Consent

In certain circumstances, we may provide you with notice that information about you might go to third parties and give you an opportunity to choose not to share the information.

  1. NOTICE TO CALIFORNIA RESIDENTS – YOUR CALIFORNIA PRIVACY RIGHTS (AS PROVIDED BY CALIFORNIA CIVIL CODE SECTION 1798.83)

A California resident who has provided Personal Information to a business with whom he/she has established a business relationship for personal, family, or household purposes (a “California Customer”) may request information about whether the business has disclosed Personal Information to any third parties for the third parties’ direct marketing purposes. In general, if the business has made such a disclosure of personal data, upon receipt of a request by a California Customer, the business is required to provide a list of all third parties to whom personal data was disclosed in the preceding calendar year, as well as a list of the categories of personal data that were disclosed. Please note that we are only required to respond to two requests per California Customer each year.

The above rights are separate from rights that California residents may have under the California Consumer Privacy Act (“CCPA”). Note that the Company is not subject to the CCPA as a “business” (as defined in the statute). Nonetheless, we respect the privacy and wishes of individuals regarding their privacy. As such, you may make a request regarding our use, handling and protection of your Personal Information by contacting us as described in Section 13, “Contact the Company” below.

  1. Security of Information

The security of your Personal Information is important to us.  When you enter sensitive information on the Site, we encrypt that information using secure socket layer technology (SSL) or other encryption methods.  We follow reasonable standards to protect the Personal Information submitted to us from unauthorized access or disclosure, both during transmission and once we receive it. However, no method of transmission over the Internet, or method of electronic or physical storage, is 100% secure.  Therefore, while we strive to use commercially acceptable means to protect your Personal Information, we cannot guarantee its security.  We assume no liability for any disclosure of data due to errors in transmission, unauthorized third-party access or other acts of third parties, or our acts or omissions.

  1. Updating Your Information

The Site may contain links to other websites.  When you click on a link to any other website or location, you will leave our Site and go to another site and another entity may collect personal and/or anonymous information from you. Our provision of a link to any other website or location is for your convenience and does not signify our endorsement of such other website or location or its contents. We have no control over, do not review, and cannot be responsible for, these outside websites or their content. Please be aware that the terms of our Privacy Policy do not apply to outside websites, and we are not responsible for the privacy practices of other websites. We encourage users of our Site to be aware when they leave our Site to read the privacy statements of each and every website that collects Personal Information. This Privacy Policy applies solely to information collected by the Company through the Site.

  1. Information From Children

The Company does not knowingly collect or solicit Personal Information from anyone under the age of 13 or knowingly allow such persons to register on our Site. If you are under the age of 13, please do not attempt to visit or register on the Site or send any information about yourself to us, including your name, address, telephone number, or e-mail address. No one under age 13 may provide any Personal Information to or on the Site. In the event that we learn that we have collected Personal Information from a child under age 13 without verification of parental consent, we will delete that information as quickly as possible. We encourage parents to monitor their children’s internet usage and/or to use web filtering technology to supervise their children’s access to the internet.

  1. Revisions to Privacy Policy and Terms of Use

If you choose to visit the Site, your visit and any dispute over privacy is subject to the terms of this Privacy Policy, any Terms of Use that we may post on our Site from time to time, and any agreement between us, including limitations on damages, and application of the laws of the state of Connecticut.  You should be aware that our business and applicable law change periodically, and this Privacy Policy will change also. Our use and sharing of information is subject to the Privacy Policy in effect at the time the information is collected. You should check our Site frequently to see recent changes.  All modifications to our Privacy Policy will be effective upon the Company’s posting such modified Privacy Policy on the Site, which is listed as the Effective Date at the bottom of this Privacy Policy. Continued use of our Services following the effective date of any such changes indicate your acknowledgement of such changes. If you do not agree to the modified provisions of this Privacy Policy, you should discontinue your use of the Site and not provide us any additional information.

  1. Opt-out of Receiving Communications

If you are no longer interested in receiving e-mail announcements and other marketing information from us, please e-mail your request to SignatureMarketing@Richmanmgt.com or click on the “unsubscribe” link in any of our e-mails.  Please include your name and mailing address (as well as your e-mail address) if you prefer not to receive direct mail postcards or catalogs.  Note that you may still receive marketing materials for a short period of time thereafter, and you will continue to receive client service related and other non-marketing communications from us.

  1. Do Not Track Disclosure

Do Not Track is a privacy preference that users can set in their web browsers. When a user turns on the Do Not Track signal, the browser sends a message to websites requesting them not to track the user.  For information about Do Not Track, visit www.allaboutdnt.org.  At this time, the Site does not respond to Do Not Track browser settings or signals. In addition, the Site may use other technology that is standard to the Internet, such as pixel tags, web beacons, and other similar technologies, to track visitors to the Site. Those tools may be used by us and by third parties to collect information about you and your internet activity, even if you have turned on the Do Not Track signal.
